Defense Lawyer for Alleged McDonald's Attacker to Argue Mistaken Identity

The lawyer for a suspect charged with attacking a McDonald's customer in Chesterfield Township plans to argue police got the wrong man.

"My case is just going to be that it was the wrong person—that it was wasn't him," Warren-based attorney Randy Rodnick said Wednesday at Court in New Baltimore.

Roland Lee Moore Jr., whose preliminary exam was waived Wednesday, is scheduled to reappear at 1:30 p.m. Thursday, Feb. 9 before Judge William Hackel III for the preliminary hearing. 

, 35, from a photo lineup as the man who stabbed and stole from a woman Jan. 31 in the drive-thru on 23 Mile Road.

A multi-jurisdictional law enforcement team nabbed the parole absconder following a , beginning in Chesterfield and ending at 9 Mile and Schoenherr. 

In response to Rodnick's request to lower Moore's $500,000 bond, prosecutors--who wanted bond raised--told Hackel that the defendant is a flight-risk who also threatened a police officer. The judge decided to keep the bond at the same amount in light of a court date set the following day.

Prosecutors are expected to call the victim, who suffered cuts to her hands, to the stand Thursday. At that time, the judge will determine if there's enough evidence in the case to bound it over to Macomb County Circuit Court in Mount Clemens.

Moore faces up to life imprisonment if convicted of armed robbery and assault with intent to do great bodily harm less than murder.
