Big Daddy's Ruling Revisited, Business May Stay

A Macomb County Circuit Court judge's ruling to shut down the dispensary operations has been revisited, company says it's not sure if it will close after all.

Company spokesman Rick Thompson said Monday Big Daddy's officials expect to view a new opinion by Macomb County Circuit Court Judge John Foster this week regarding the .

Foster ruled Nov. 30 in favor of the , Chesterfield Township Police Chief Bruce Smith and Chesterfield Township that the distribution to stop. A main issue that arose during the evidentiary hearing in early November was the patient-to-caregiver ratio at the dispensary and whether the business complied with the state medical marijuana laws.

Big Daddy’s Management Group then asked Foster to clarify the ruling and the judge agreed the dispensary should be allowed to operate under the guidelines of the 2008 Medical Marihuana Act.

“I will sit down and rewrite this opinion,” Foster was quoted saying in a Dec. 21 article in The Macomb Daily. “I cannot prohibit what the people of the state of Michigan passed and what the Court of Appeals approved.”

In light of the judge's decision, Thompson said the company's previous plan to close the Chesterfield facility and relocate to another, undetermined town outside of Macomb County are up in the air. Big Daddy's officials have decided not to further comment on the issue until they have read the opinion, he said.
