Macomb Judge Dismisses Lawsuit Against DIA

The plaintiffs said they filed the lawsuit against the Detroit museum after they were charged for an exhibit.

A Macomb County Circuit Court judge on Wednesday dismissed a lawsuit filed by five county residents against the Detroit Institute of Arts, according to court records. Plaintiffs Simon Haddad of Clinton Township, Leon Drolet of Macomb Township, Judy and Dennis Buchholtz of Warren and Philis DeSaele of Sterling Heights alleged in the lawsuit they were denied free admission Dec. 1 to the Faberge exhibit—which they contend violated terms of a tri-county millage. Judge John Foster's opinion, including the denial to amend their pleadings, means the case is closed, the Detroit Free Press reported. Woman Accused of Fishing Thousands From Employer's Safe Pleads Guilty

The 21-year-old New Baltimore defendant is scheduled for sentencing next month.

A woman accused of stealing about $60,000 from her New Baltimore employer entered a guilty plea this month, according to Macomb County Circuit Court records. Taylor Klein, 21 of New Baltimore, pleaded guilty March 7 to felony embezzlement between $50,000 to $100,000 for the theft at Sunoco gas station on 23 Mile Road, the day her trial was to begin. Klein, who also pleaded guilty to misdemeanor possession of marijuana, is scheduled for sentencing April 18 before Circuit Judge Mary Chrzanowski. She is expected to pay $57,000 in restitution to the former employer, court records show. Her lawyer Donald Teichman Jr. said Wednesday it will be determined at sentencing if she will serve jail time and declined to further elaborate on the plea.  On…

Macomb County Judge David Viviano Appointed to State Supreme Court

David Viviano, chief judge of the Macomb Circuit Court, was appointed Wednesday to serve on the Michigan Supreme Court.

Gov. Rick Snyder has appointed Macomb Circuit Court Chief Judge David Viviano to the Michigan Supreme Court. Viviano, 41, has served on the 16th Circuit Court bench since 2006 and takes the open seat created by the resignation of former Justice Diane Hathaway. "Judge Viviano has a distinguished record of judicial integrity and innovation," Snyder said in a release. "His deep respect for the judicial branch of government and his commitment to the rule of law will serve Michigan well." Viviano, who holds degrees from Hillsdale College and the University of Michigan Law School, previously was in private practice and served as the city attorney for Center Line. Trial Set for Alleged New Baltimore Gas Station Thief

A 21-year-old woman is accused of stealing approximately $60,000 from her employer at the Sunoco gas station on 23 Mile Road.

A trial date has been set for a New Baltimore woman accused of stealing thousands from her employer's safe, according to court records. Taylor Klein, 21, is scheduled to appear March 7 before Judge Mary Chrzanowski in Macomb County Circuit Court in Mount Clemens. Klein faces a 15-year felony of embezzlement between $50,000 to $100,000 for allegedly stealing approximately $60,000 from her employer at the Sunoco gas station on 23 Mile Road. She is suspected of fishing cash out of the top of a safe deposit slip, police said. Investigators said they identified her on surveillance footage and recovered more than $50,000 from her apartment. Chesterfield Township Man Pleads Guilty to McDonald's Stabbing, Robbery

Roland Lee Moore Jr. was scheduled to face trial Tuesday in Macomb County Circuit Court.

A Chesterfield Township man pleaded guilty Tuesday to charges he robbed and stabbed a McDonald's customer in the drive-thru lane last winter. Roland Lee Moore Jr., 36, pleaded to one count of assault with great bodily harm less than murder and armed robbery before Macomb Circuit Judge David Viviano, according to court records. The plea took place on the first day of his scheduled trial in Mount Clemens and followed his initial rejection of a deal last month. Under the agreement, Moore is to serve between 12 and 25 years, the records show. He faced up to life imprisonment upon conviction of the charges. He is scheduled for sentencing at 9 a.m. Feb. 26. Trial Slated This Week for Alleged McDonald's Stabber

Roland Lee Moore Jr., of Chesterfield Township, is scheduled for trial Jan. 29 in Macomb County Circuit Court in Mount Clemens.

A trial for a parole absconder accused of stabbing and robbing a fast-food customer in Chesterfield Township is scheduled to begin Tuesday. Roland Lee Moore Jr. faces up to life in prison if convicted of armed robbery and assault with intent to do great bodily harm less than murder for the Jan. 31, 2012 attack in the McDonald's restaurant at 23 Mile near Interstate 94. During the incident, a woman in the drive-thru lane was stabbed in the hand and her belongings were stolen. Moore turned down a deal calling for him to face between 12 and 23 years, his defense attorney Randy Rodnick said in early December.  That move would have paved the way for him to possibly receive the lighter end of the sentence in exchange for the guilty plea, but …

New Baltimore Gas Station Embezzlement Case Heads to Macomb County Circuit Court

A New Baltimore woman faces embezzlement and possession of marijuana charges.

An embezzlement case stemming from a New Baltimore gas station was bound over to Macomb County Circuit Court. New Baltimore resident Taylor Klein, 21, waived her preliminary exam Jan. 2 in 42-2 District Court. Klein is expected to have a pretrial hearing and arraignment at the higher court in Mount Clemens Jan. 14 before Circuit Judge Mary Chrzanowski, according to court officials and records.  Klein faces a 15-year felony of embezzlement between $50,000 to $100,000 for allegedly stealing approximately $60,000 from her employer at the Sunoco gas station on 23 Mile Road. Overdue on Child Support? Macomb County Officials Say Pay Up Now or Face Arrest

Macomb County residents with outstanding bench warrants for overdue child support payments are encouraged to pay up by Dec. 10 or face arrest.

The Macomb County Sheriff and Circuit Court are giving individuals who are overdue on their child support payments fair warning to either pay up by next week or face arrest. Macomb County Sheriff Anthony Wickersham and Chief Circuit Court Judge David Viviano annouced Wednesday that their offices would be conducting a four-day sweep in an effort to arrest those who are delinquent on their child support payments and have outstanding bench warrants. Sheriff Wickersham’s Friend of the Court Enforcement Unit will devote extra resources to identifying and contacting these individuals from Dec. 10 through Dec. 13. Wickersham and Viviano encourage residents with overdue payments to visit the Friend of the Court Office prior to the sweep to make …

Accused Kohl's Parking Lot Robber Pleads Guilty

Marvin Lee Hopkins, 63, of Chesterfield Township, is scheduled for sentencing Dec. 19 in Macomb Circuit Court.

A 62-year-old Chesterfield Township man accused of holding someone up in the Kohl's parking lot pleaded guilty this month. Marvin Lee Hopkins pleaded to one count of armed robbery Nov. 15 in Macomb Circuit Court in Mount Clemens. Under the deal, prosecutors agreed not to add the charge of third-degree habitual offender. Armed robbery is a felony punishable by up to life imprisonment, according to court records. Hopkins is scheduled to be sentenced at 9 a.m. Dec. 19 before Circuit Judge Peter Maceroni. Police say he approached a 55-year-old Chesterfield Township woman in a late September afternoon at the department store lot, grabbed her arm, stole her purse while threatening to kill her.
